Usufruct Scale 2025 - Calculation by Age

The usufruct scale (article 669 of the CGI) defines how value is split between usufruct and bare ownership according to the age of the usufructuary. At 70 years, the usufruct is worth 40% of the property and the bare ownership 60%. This scale is used for gifts, inheritances and life annuity sales in Luxembourg.

How to Calculate the Usufruct in 5 Steps

Determine the market value of the property

Estimate the market value of the property (vacant value). Call on an approved expert if necessary. This value is the basis for all calculations.

Identify the age of the usufructuary

Note the exact age of the usufructuary on the day of the transaction (sale, gift). This age determines the applicable coefficient.

Application to the Occupied Life Annuity

In an occupied life annuity, the usufruct scale is used to calculate the occupancy discount. As the seller keeps the usufruct (or the right of use and habitation), the buyer pays only for the bare ownership.
