The viager.lu website is published by The CMO.lu S.à r.l.-S, a simplified private limited liability company under Luxembourg law, registered with the Luxembourg Trade and Companies Register under number B304999, whose registered office is established at 4, rue Josy Printz, L-5841 Hesperange, Grand Duchy of Luxembourg (hereinafter "the Publisher").

The site's sole purpose is (i) to provide general and educational information relating to the life annuity in Luxembourg and (ii) to put users in contact with independent real estate agents specialised in life annuities, duly approved to operate in the Grand Duchy of Luxembourg.

Access to and use of the viager.lu site are subject to the acceptance of and compliance with these Terms of Use. By accessing the site, you accept these terms without reservation.

The viager.lu site offers, free of charge for the user, the following services:

• Information on the occupied life annuity and the vacant life annuity
• Life annuity simulator for indicative purposes
• Glossary of life annuity terms
• Guides and advice for senior homeowners
• Contact and matchmaking form with partner real estate agents specialised in life annuities

The Publisher does not carry out the activity of real estate agent, nor that of broker, investment adviser, tax, wealth or legal adviser, nor that of notary. It acts exclusively as a provider of information and matchmaking services. As such, it holds no mandate, negotiates no transaction, drafts no deed, intervenes at no stage of the contractual relationship that may be established between the user and a professional put in contact, and receives no commission linked to the effective conclusion of a life annuity transaction.

The partner real estate agents are independent professionals who hold, under their own responsibility, all the establishment authorisations, approvals, professional civil liability insurance and financial guarantees required by Luxembourg legislation for the management of mandates and the sale of real estate, including life annuities, in the Grand Duchy of Luxembourg.

The life annuity simulator available on the site is provided purely for indicative purposes. The results in no way constitute a firm offer or a commitment on our part. Only a personalised estimate carried out by our experts can determine the exact value of your property as a life annuity.

All the contents of the site (texts, images, logos, graphics) are protected by intellectual property law. Any reproduction, even partial, without prior authorisation is prohibited.

The personal data collected via the site's forms is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the Luxembourg law of 1^st August 2018 on data protection.

User rights. You have at any time a right of access, rectification, modification, erasure (deletion), restriction, objection and portability of your personal data. To exercise one of these rights, you must make an express request, in writing, by email to the address: contact@viager.lu, accompanied by proof of identity. A response will be provided to you within a maximum period of one (1) month.

7.1 Information. The Publisher reasonably implements the means at its disposal to provide reliable and up-to-date information. It cannot however guarantee the accuracy, completeness, precision or topicality of the information disseminated on the site. The information published has a strictly indicative value and in no way replaces personalised professional advice.

7.2 Matchmaking. The Publisher acts as a mere technical intermediary facilitating contact between the user and independent professionals. It is not party to any contractual, pre-contractual, commercial or negotiated relationship between the user and the said professionals.

Consequently, and to the fullest extent permitted by law, the Publisher may in no case be held liable, whether civilly, criminally, commercially or administratively, in Luxembourg or abroad:

• for the services, advice, estimates, valuations, appraisals, negotiations or services provided by the professionals put in contact ;
• for the conclusion, performance, non-performance, renegotiation, cancellation or validity of any contract, mandate or deed entered into between the user and these professionals ;
• for the conduct, statements, breaches, faults, negligence, advisory failings or possible fraud of the professionals or users put in contact ;
• for any direct or indirect, material, financial, wealth, tax, commercial, moral or immaterial damage resulting from the use of the site or the consequences given to a matchmaking ;
• for any loss of chance, opportunity, revenue, data, operations or anticipated savings.

7.3 Independence of the partners. The professionals put in contact operate under their own business name, remain sole holders of their approvals, authorisations, insurance and ethical obligations, and are solely responsible for their services. It is up to the user to verify their authorisation and their conditions of intervention before any commitment.

7.4 User guarantee. The user undertakes to guarantee and indemnify the Publisher against any claim, action, complaint, proceeding or conviction emanating from a third party in direct or indirect connection with the use they have made of the site or the consequences given to the introductions obtained via the site.

7.5 Force majeure and availability. The Publisher may not be held liable for the non-performance of its obligations in the event of force majeure, technical malfunction, breakdown, service interruption, cyber-attack or any event beyond its control. The site is provided "as is".

The site may contain links to other websites. Viager Luxembourg is not responsible for the content of these external sites.

These terms of use, the use of the viager.lu site as well as any relationship, direct or indirect, between the Publisher and the user are exclusively governed by Luxembourg law, to the exclusion of any conflict of laws rule. In the event of a dispute, and after the failure of any attempt at amicable settlement, the courts of the Grand Duchy of Luxembourg, city of Luxembourg, shall have sole jurisdiction, notwithstanding the plurality of defendants, the third-party claim, the nationality of the user or their place of residence, including in the event of emergency, protective, application or summary proceedings.
