The CMO.lu S.à r.l.-S publishes the viager.lu website in its capacity as an information and matchmaking service provider. The site's exclusive purpose is:

• to provide general, educational and documentary information relating to the life annuity in the Grand Duchy of Luxembourg;
• to put visitors to the site (owners, buyers, interested individuals) in contact, free of charge for the user, with independent real estate agents specialised in life annuities, established and approved in accordance with Luxembourg legislation.

The CMO.lu S.à r.l.-S does not carry out the activity of real estate agent, nor that of broker, nor that of investment adviser, nor that of legal, tax, wealth or notarial adviser. The CMO.lu S.à r.l.-S holds no sale or purchase mandate, negotiates no transaction, drafts no deed, intervenes at no stage of the contractual relationship that may be established between the site's users and the professionals put in contact, and receives no commission linked to the effective conclusion of a life annuity transaction.

Professional partners. The partner real estate agents put in contact via viager.lu are independent professionals who hold, under their own responsibility, all the establishment authorisations, ministerial approvals, professional registrations, professional civil liability insurance and financial guarantees required by Luxembourg legislation for the management of mandates and the negotiation of sales of real estate, including life annuities, in the Grand Duchy of Luxembourg. They operate under their own business name and remain solely responsible for their services.

The contents, articles, estimates, simulations, guides and tools made available on viager.lu are provided for strictly informational and educational purposes. They in no way constitute personalised advice, a solicitation, an offer, a recommendation, or a contractual commitment of any nature whatsoever.

5.2 Matchmaking service. The CMO.lu S.à r.l.-S acts as a mere technical intermediary facilitating contact between users and independent professionals specialised in life annuities. It is not party to any contractual, pre-contractual, commercial or negotiated relationship, concluded or to be concluded, between users and these professionals, nor between users themselves.

Consequently, and to the fullest extent permitted by applicable law, The CMO.lu S.à r.l.-S may in no case be held liable, whether civilly, criminally, commercially or administratively, in Luxembourg or abroad:

• for the services, advice, recommendations, estimates, valuations, appraisals, diagnostics, negotiations or services provided by the professionals put in contact via the site;
• for the conclusion, performance, non-performance, renegotiation, termination, cancellation or validity of any contract, agreement or deed entered into between users and professionals, or between users themselves;
• for the content, form, legal, tax, notarial, accounting or regulatory compliance of the deeds and documents drawn up following a matchmaking;
• for the conduct, statements, breaches, faults, negligence, advisory failings or possible fraud of the professionals or users put in contact;
• for any direct or indirect, material, financial, wealth, tax, commercial, moral or immaterial damage resulting from the use of the site, from the contacts established through it, or from the consequences given to those contacts;
• for any loss of data, chance, opportunity, revenue, operations or anticipated savings.

5.3 Independence of the professionals. The professionals put in contact are independent providers, legally and financially autonomous, sole holders of their approvals, authorisations, professional insurance and ethical obligations. It is up to the user to verify their authorisation and their conditions of intervention before any commitment.

5.4 User guarantee. The user undertakes to guarantee and indemnify The CMO.lu S.à r.l.-S against any claim, action, complaint, proceeding or conviction emanating from a third party, in direct or indirect connection with the use they have made of the site, with the information they have communicated on it, or with the consequences given to the introductions obtained via the site.

5.5 Force majeure and availability. The CMO.lu S.à r.l.-S may not be held liable for the non-performance of its obligations in the event of force majeure, technical malfunction, breakdown, service interruption, cyber-attack or any event beyond its control. The site is provided "as is" and without guarantee of continuous availability.

5.6 Simulations and estimates. The simulators, estimates of bouquet, annuity, property value or yield made available on the site are educational tools based on simplified assumptions. They in no way constitute an offer, an appraisal, a commitment, personalised advice or an investment recommendation. Only an approved professional, a notary or a real estate expert is authorised to issue an enforceable valuation or advice.

The viager.lu website may contain hyperlinks to other sites. The CMO.lu S.à r.l.-S exercises no control over these external sites and disclaims any liability as to their content.

The creation of hyperlinks to the viager.lu site is authorised provided that they are not used for commercial or advertising purposes without prior written agreement.

In any event, the links must in no case harm the image of The CMO.lu S.à r.l.-S or its services.

The personal data collected via the viager.lu website (in particular when using the contact, estimate, simulation or guide request forms) is processed by The CMO.lu S.à r.l.-S in strict compliance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the Luxembourg law of 1^st August 2018 on the protection of natural persons with regard to the processing of personal data.

This data is collected for the sole purposes of information, responding to requests, and matchmaking with the partner professionals. It may be transmitted to the selected partner real estate agents, solely for the purpose of processing the user's request. No data is resold to third parties for commercial purposes.

User rights. In accordance with the GDPR, you have at any time a right of access, rectification, modification, erasure, restriction, objection and portability concerning your personal data, as well as the right to withdraw your consent and the right to define directives relating to the fate of your data after your death.

To exercise one of these rights, you must make an express request, in writing, to the following email address: contact@viager.lu. Any request must be accompanied by proof of identity making it possible to ascertain the capacity of the applicant. The CMO.lu S.à r.l.-S undertakes to respond within a maximum period of one (1) month from receipt of the complete request.

In the event of disagreement on the processing of your data, you have the right to lodge a complaint with the National Commission for Data Protection (CNPD), the competent supervisory authority in Luxembourg.
